The NCDS election set as May/2nd/2009! ------ ----Date/April/8th/2009

The Nuer Community Development Service (NCDS)
United States of America.
Guidelines of the Election

These guidelines are rules and regulations of the Nuer Community Election in the United States of America, and do not apply to other Nuer Communities at other continents in the world.

1.On 28th of March 2009 Gen. Paulino Matip Nhial called a meeting in his house in Minnesota to resolve the disputed election between the two rivals, Mr. Brown Both Bol and Mr. Khon Kueth Mar. Gen. Nhial heard from both sides and concluded that the only way to resolve the disputed election is to have another election. Gen. Nhial delegated Hon. Ezekiel Lol Gatkuoth, the member of the SPLM National Liberation Council, the SPLM Representative to USA and the Head of Mission for the Government of Southern Sudan Mission to the United States of America, to supervise the next election.

2.Base on the first election which was conducted on the 27th of December 2008, it resulted in a disputed outcome and it was caused by the outside states votes that were reported during the election. To avoid irregularities for this coming election, it is decided by the electoral committee in conjunction with the decision made by General Paulino Matip Nhial to have the voting take place in any state chosen by the electoral committee. If any campaign camp has supporters outside of the state selected, the campaign team must inform their supporters to come to the election in the state where the election is decided to take place.

3.The electoral committee shall set up the date for the election four weeks prior to the election to convene. This is to allow time for the candidates to campaign and mobilize their supporters. It is asked that the candidates be cautious from the negative campaign.

4. Polling Station

•There will be only one polling station.
•You must be present at the polling station to vote.
•Polling station must be opened and closed within the scheduled time.
•All voters will be made aware of the voting and closing time.

5.Voting Requirements

1.You must be resided within the United States.
2.You must be eighteen (18) year old and above for you to be eligible to vote.
3.You must be registered at the polling station
4.You must show a picture ID to verify your age and residency
5.You must be a Nuer or Non Nuer women married by the Nuer people

5.Casting of Votes
1.One vote per person, duplication is not allowed. Voting fraud is a crime under the conventional voting laws.
2.Votes will be cast with the supervision of the Chairman of the electoral Committee.
3.Members of the electoral committee will give voters instruction before the vote.
4.Mark an “X” or a check mark next to the person you are voting for.
5.Do not write your name or initial to prevent linkage of identity.
6.Should you have any difficulty in marking your ballot, please see one of the electoral committee.
7.Only the electoral committee to be present around the ballot box.
8.Any member of the electoral committee is not allowed to promote, campaign for a candidate at the polling station and not allowed to vote for a candidate.
9.All the voters must vote in a secret ballot.

6.Determination of the winner
•A candidate that receives the majority of votes must be declared as a winner by the Chairman of the Electoral Committee.
•Should election resulted into a tie vote, there will be no winner and a run-off election will be called.
7.Run-Off Elections
•All run-off elections will be conducted accordance to the applicable rules and regulations of this election.
•The dates and times of the run-off election will be made available to the candidates and the voters.
